Terms of Service

Effective date: August 31, 2026

These Terms of Service ("Terms") govern your use of The Sitdown Firm's website and the information and materials on it. By using the website, you agree to these Terms. If you do not agree, please do not use the website.

1. Who we are and what these Terms cover

The Sitdown Firm provides marketing, qualification, and scheduling services to financial professionals. These Terms cover use of our website only. If you become a client, our services are governed by a separate written service agreement between you and The Sitdown Firm; if there is any conflict between that agreement and these Terms, the service agreement controls.

2. Business use and eligibility

Our website and services are intended for business use by professionals aged 18 or older. Information you submit about a practice should be accurate and submitted by someone authorized to provide it.

3. Not financial, legal, or professional advice

We are not a broker-dealer, investment adviser, or insurance producer, and nothing on this website is financial, investment, insurance, tax, or legal advice — to businesses or to consumers. Content on this website is provided for general information about our services.

4. Service descriptions and guarantees

Descriptions of our programs, deliverables, and guarantees on this website are summaries. The specific commitments that apply to any client engagement — including any appointment guarantees, territory terms, timelines, and remedies — are those set out in that client's written service agreement. Appointment figures and examples on this website describe our service standards and illustrative scenarios, not any client's business outcomes; results from appointments depend on each practice's own process.

5. Acceptable use

You agree not to misuse the website, including by: submitting false or misleading information; attempting to interfere with the website's operation or security; scraping or harvesting data; using the website to send unlawful communications; or copying substantial portions of the website's content for competing commercial use.

6. Intellectual property

The website and its content — including text, design, graphics, and the name The Sitdown Firm — are owned by us or our licensors and are protected by applicable intellectual-property laws. We grant you a limited, revocable license to view and use the website for its intended purpose. No other rights are granted.

7. Third-party services and links

The website may link to or embed third-party services, such as scheduling tools. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

8. Privacy

Our collection and use of information is described in our Privacy Policy, which is part of these Terms.

9. Disclaimers

The website is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, The Sitdown Firm will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or relating to your use of the website. Our total liability for any claim relating to the website will not exceed one hundred U.S. dollars ($100). Liability relating to client engagements is addressed in the applicable service agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold The Sitdown Firm harmless from claims arising out of your misuse of the website or violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute relating to these Terms or the website will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. The effective date above reflects the latest version, and continued use of the website after changes are posted constitutes acceptance of the updated Terms.
